According to Arizona state officials, no it's not. The new legislature, which states that doctors who fail to clearly articulate an unborn child's risk of birth defects are protected against malpractice suits, is meant to prevent women from having abortions. The Senate proposed this bill that would eliminate malpractice suits against doctors who allegedly did not make clear the risks of defects or disabilities of an unborn child. Some parents of children with disabilities or birth defects have attempted to sue doctors for a child that "should not have been born." They state that if they were made privy to their child's risks, they would have considered an abortion. The new law would prevent such lawsuits and give anti-abortion doctors a free pass to essentially lie to their patients. Section A of Senate Bill 1359 states: "a person is not liable for damages in any civil action for wrongful birth based on a claim that, but for an act or omission of the defendant, a child or children would not or should not have been born." This information is usually printed on the denial letter or Explanation of Benefits document that is sent by the carrier. Generally, the insurance plan will govern coverage. Therefore, it's imperative to review the plan and summary to see whether the procedure or treatment is covered under the plan and whether you have followed the procedures set forth in the plan. For example, your plan may require a referral from a primary care physician or prior authorization for certain hospital surgeries or procedures.  Even if the plan does not expressly cover the procedure or treatment, state law may require coverage. You can contact your state's insurance commissioner to investigate whether or not coverage is mandated by law. These bills are intended to help families in need pay for necessary therapy for children with autism.   In Florida, healthcare regulators suggest that poor families do not have the resources needed to properly treat autism. Therapy is needed for children with autism to lead more normal lives, and this legislature is meant to help these children receive the proper care. U. S. District Judge Joan Lenard signed an order for the state Medicaid insurance program to pay for psychological treatment, known as applied behavior analysis (ABA), to improve the development of children with autism.   While many commercial carriers provide ABA, those families who were previously denied benefits could begin to receive care — this change allows poor families to obtain autism coverage.   Previously, applied behavior analysis was called "experimental treatment" and was not covered for many families.
